1. About these terms
These Terms form a binding agreement between you and Toddle. They apply to anyone who accesses or uses our website, mobile experience or related services (together, the "Services"). If you do not agree, please do not use the Services.
2. Who can use Toddle
You must be at least 18 years old and able to enter into a binding contract under UK law. If you use the Services on behalf of a nursery, school or other organisation, you confirm that you have authority to bind that organisation to these Terms.
3. The Services we provide
Toddle is an information and enquiry platform that helps parents discover and compare childcare providers. We are not a childcare provider ourselves and do not deliver childcare services. Information about nurseries (including fees, availability, Ofsted ratings and facilities) is supplied by providers, public sources or our own research, and may change without notice.
Decisions about which provider to choose for your family are entirely your own. You are responsible for carrying out your own visits, checks and due diligence before enrolling a child.
4. Accounts
Some features (such as provider dashboards or saved shortlists) require an account. You agree to provide accurate information, keep your credentials confidential and notify us promptly of any unauthorised use. You are responsible for all activity that occurs under your account.
5. Acceptable use
You agree not to:
- Use the Services for any unlawful, fraudulent or abusive purpose.
- Submit false, misleading or defamatory information.
- Scrape, copy or republish content without our written consent.
- Interfere with the operation or security of the Services.
- Send spam, harass providers, or contact nurseries other than through legitimate enquiries.
- Upload viruses, malware or other harmful code.
We may suspend or terminate access where we reasonably believe these rules are breached.
6. Enquiries and provider communications
When you submit an enquiry through Toddle, we share the relevant details with the provider(s) you select so they can respond. We do not control whether or how providers respond, the accuracy of their replies, or the services they offer. Any contract for childcare is between you and the provider directly.
7. Provider listings and content
Providers who list on Toddle are responsible for the accuracy of their listing, photographs, fee information, availability and other content. Providers grant Toddle a non-exclusive licence to display this content as part of the Services. We may edit or remove listings that breach these Terms or our content standards.
8. Reviews and user content
Where users submit reviews, comments or other content, you are responsible for it and confirm it is truthful, lawful and your own. You grant Toddle a worldwide, royalty-free licence to host, display and adapt that content for the operation and promotion of the Services. We may moderate or remove content at our discretion.
9. Fees
Toddle is free for parents. Some features for nurseries and other providers are paid (for example lead packages or premium listings); pricing and terms for those features are set out at the point of purchase. All amounts are in GBP and exclusive of VAT unless stated otherwise.
10. Intellectual property
The Toddle name, logo, website design, software and original content are owned by Toddle or our licensors and are protected by intellectual property laws. You may not use them without our prior written consent, except as permitted by these Terms or by law.
11. Third-party links
The Services may link to third-party websites, including provider websites. We are not responsible for the content, products or services available on those sites and their use is governed by their own terms and privacy policies.
12. Disclaimers
The Services are provided "as is" and "as available". We do not warrant that the Services will be uninterrupted, error-free, or that information about providers is accurate, complete or current. To the maximum extent permitted by law, we exclude all implied warranties.
13. Limitation of liability
Nothing in these Terms limits or excludes liability that cannot be limited or excluded by law (including for death or personal injury caused by negligence, or for fraud). Subject to that:
- We are not liable for any loss or damage that is not reasonably foreseeable.
- We are not liable for loss of profits, business, goodwill or data.
- Our total aggregate liability arising out of or in connection with the Services is limited to £100 or the amount you paid us in the 12 months before the claim arose, whichever is greater.
14. Indemnity
You agree to indemnify and hold Toddle harmless from any claims, losses and expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Services or content you submit.
15. Suspension and termination
You may stop using the Services at any time. We may suspend or terminate your access if you breach these Terms, if we are required to do so by law, or if we discontinue the Services. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability and governing law) will do so.
16. Changes to these terms
We may update these Terms from time to time. If we make material changes, we will notify you via the website or by email where appropriate. Continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
17. Governing law and jurisdiction
These Terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction over any dispute arising out of or in connection with them, except that consumers may bring proceedings in their country of residence where required by law.
